Whistleblower investigation
Nonpartisan investigation following a whistleblower’s allegations of fatal flaws and behavioural problems in an IOC. The client accepted our findings and change management proposals.

Root cause investigation
An IOC suffered a major security incident in Mozambique, that led to curtailment of the megaproject’s development.  On behalf of General Counsel, we led the forensic investigation into the incident’s causes and other contributing factors. This was a wide-ranging exercise that identified serious flaws in intelligence fusion, decision making and organizational factors.

Success in international arbitration – expert witness
The World Bank’s ICSID Tribunal accepted our argument that there were serious and consequential flaws in the Claimant’s risk strategy. This helped to reduce our client Pakistan’s liability by $US 8.5 billion. Tethyan Copper Company Pty Ltd. v. Pakistan.

Correctly forecast key outcomes of the Russia-Ukraine war
While conventional wisdom focused on early Russian setbacks in Ukraine, we had the conviction to take an out-of-consensus view that Russia would regain the upper hand. We made a firm prediction that Russia would regenerate its armed forces to threaten Europe after the cessation of intense fighting in Ukraine.

Our client was exposed to a diverse array of security threats in Africa and LatAm. On behalf of the newly appointed Global Head of Security, we wrote new company policy, minimum standards and guidelines, and provided implementation support and training to the country-level teams.

Social Licence to Operate
A major energy company was developing oil extraction from agricultural crops in Africa. We conducted workshops, interviews, and discussion groups to ensure the community’s lived experiences were heard by the company, and not others’ interpretations. This also initiated a degree of mediation and trust-building between the company and communities, acting to transform nascent conflict and build a robust Social Licence to Operate.

We made the very early call that the US would step back from Article 5 commitments and that European states should commit to immediate and rapid up-armament.

We made a positive call on market entry for a mining client in Balochistan. Despite endemic and growing insurgency threats, we supported market entry based on strong intelligence and our direct experience of resilient mitigation planning in Balochistan and similar places.

A fatal security incident raised serious questions about our client’s security contractor. On behalf of General Counsel, our investigation revealed flaws in contracts, potential breaches of contract by the contractor, and other evidence of professional negligence.
